User Responsibility & Use of the Service
Your Responsibility When Using Ask Luma
You are responsible for your use of Ask Luma and for any content you provide to the app. You agree not to use Ask Luma in any way that is unlawful, harmful, or inconsistent with these Terms.
In particular, you agree that you will not use Ask Luma to:
Seek or rely on urgent medical, crisis, or emergency assistance
Share illegal content, or content that infringes the rights of others
Upload or share highly sensitive personal information (such as health records, financial account details, or government identification numbers)
You understand that AI-generated content may sometimes be incorrect, incomplete, or misleading. You should use your own judgment and, where appropriate, obtain independent professional advice before acting on any information provided by the app.
We may update, modify, or restrict access to Ask Luma (in whole or in part) from time to time, and we may suspend or terminate your access if we reasonably believe you are misusing the service or violating these Terms.
Limitation of Liability
To the maximum extent permitted by applicable law, Ask Luma, its affiliates, and their respective owners, officers, employees, contractors, and service providers will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages (including, without limitation, loss of profits, loss of revenue, loss of data, business interruption, or other intangible losses) arising out of or relating to your use of or inability to use the app or any content generated by it, whether based on warranty, contract, tort (including negligence), strict liability, statute, or any other legal theory, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to your use of the app will not exceed the total amount you have actually paid to us for access to the app during the twelve (12) months immediately preceding the event giving rise to the claim, or, if greater, the minimum amount required under applicable law.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the exclusions and limitations above apply only to the extent permitted by applicable law, and our liability will in any event be limited to the fullest extent permitted by applicable law.
